By accessing or using the Waggly Club website (the "Site") and subscribing to our services (the "Services"), you indicate your unconditional acceptance of these Terms and Conditions of Service (the "Terms"). Please read these Terms carefully as they govern your use of Waggly Club. If you do not agree to these Terms, you may not access or use the Site or subscribe to our Services.

Scope of Service

Waggly Club provides a subscription-based service for dog owners to receive monthly deliveries of dog-related toys, treats and accessories. By subscribing to our Services, you agree to comply with these Terms and any additional guidelines or rules posted on the Site.

Website Content

All content on the Waggly Club website, including text, images, graphics, logos, videos, and software, is the property of Waggly Club or its licensors and is protected by intellectual property laws. You may not use, reproduce, modify, or distribute the content without prior written permission from Waggly Club.

Registration and Subscriptions

To subscribe to Waggly Club, we require you to provide accurate and complete information. You are responsible for updating your billing and delivery information.

Waggly Club offers subscription plans with different contract periods, including 1 month and 6 months. When you sign up for a subscription, cancellations during this contractual period are not permitted.

Monthly Delivery

Waggly Club will deliver a curated selection of dog products to the address provided during registration. We will make reasonable efforts to ensure timely delivery; however, delivery times may vary depending on factors beyond our control.

Billing

By subscribing to Waggly Club, you agree to pay the applicable subscription fees as outlined on the Site. You authorize us to charge your selected payment method for the recurring subscription fees. All payments are non-refundable unless otherwise stated

Please note that Waggly Club reserves the right to adjust the billing date under certain circumstances. We understand that you may prefer a specific billing date, and we are pleased to offer you the option to lock in a date that is most convenient for you. However, in the event that we need to make changes to the billing date, we will communicate this to you in writing well in advance to ensure transparency and clarity regarding any adjustments.

Subscription Renewals

Once your subscription has expired and you did not cancel your subscription, you will be transitioned to a month-to-month plan at the same price you originally signed up for. You have the flexibility to manage your subscription, including the ability to cancel or modify your renewal
preferences by reaching out to our support team.

Payment

You are responsible for providing accurate and up-to-date payment information. We will continue to attempt processing your payment using the provided payment method until it is successfully completed.

Shipping/Delivery

We will deliver the monthly subscription box to the shipping address provided during registration. You are responsible for ensuring the accuracy of the shipping address. Waggly Club is not liable for any delays, lost packages, or delivery errors caused by incorrect address information.

Cancellation Policy

Customers have access to a cooling off period for 10 business days from the time of purchase. This means that after your purchase, if you don’t think the service is right for you, you have 10 business days to end your subscription early without cancellation fees. However, we will ask you to send back the complete, unused contents of the order for a full refund. Refunds will be processed once we receive the contents back.

If you wish to cancel your ongoing membership after the cooling off period, you can do so by reaching out to our dedicated customer support team. Your subscription will remain active until you cancel it. If you decide to cancel your membership before the end of your existing subscription period, you will be charged for the remaining duration of your subscription plan.

We reserve the right to terminate your membership, without prior notice, if we believe your conduct violates these Terms of Service or our policies, poses harm to our business interests, or if your account remains inactive for 5 consecutive months.

Promotions and Offers

From time to time we run “Free Gift” offers and promotions when you subscribe to a 6 month subscription.  These are the terms and conditions that govern those promotions:

• In order to claim a free gift, you must subscribe to a 6 month subscription on an offer landing page. In the event that you have subscribed to the no offer landing page, you will be not qualified for any free gift.
• Delivery or postal charges may be payable by you in respect of your subscription box and free gifts and this will be shown on the checkout page.
• The free gift cannot be substituted for any other item, cash or credit.
• The free gift is sent with your order.
• If a customer wishes to return an order or item which qualified for a free gift with purchase, the transaction can only be refunded if the gift with purchase item is also returned.
• We reserve the right to amend these terms and conditions at any time. If we do this we will
  publish the amended terms and conditions on this page.

We also offer credits for customers who sign up on Month to Month subscription:

• Customers who sign up on Month to Month subscription will get $5 credit every box paid.
• The $5 credit will be automatically applied to the next order.
• The $5 credit expires in 45 days.
• The customer must pay their next box within 45 days so that the credit can be applied.

Content Submitted by Users

By submitting any content, such as reviews, testimonials, or photos, to Waggly Club, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display the content in any media.

Prohibited Content

You must not submit or post any content that is unlawful, harmful, abusive, offensive, defamatory, or infringing on the rights of others. Waggly Club reserves the right to remove any prohibited content and terminate your access to the Site and Services.

Minors

Waggly Club is intended for use by adults aged 18 years and older. If you are under 18, you may use the Site and subscribe to our Services only with the involvement of a parent or guardian.

Intellectual Property Rights

Waggly Club retains all rights, title, and interest in and to its intellectual property, including trademarks, logos, and service marks. You may not use any Waggly Club trademarks or logos without our prior written permission.

Copyright Infringement

Waggly Club respects the intellectual property rights of others. If you believe that your copyright has been infringed upon, please notify us promptly with the necessary information to investigate and take appropriate action.

Security

Waggly Club takes reasonable measures to protect the security and integrity of your personal information. However, no data transmission over the internet or storage system can be guaranteed as 100% secure. You acknowledge and accept the risks associated with transmitting data online.

Limitation of Liability

Waggly Club and its affiliates, directors, officers, employees, or agents shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising from your use of the Site or Services.

Indemnification
